Permanent residence card is a document issued by the immigration authority to a foreigner who is allowed to reside indefinitely in Vietnam and have validity longer than a Visa. Because this type of card is valided until 10 years, the conditions for being granted a permanent residence card are very strict.

Compared with the provisions of the Ordinance on entry, exit and residence of foreigners in Vietnam, the Law on entry, exit, transit and residence of foreigners in Vietnam was promulgated on June 16, 2014. There are more specific regulations on conditions for foreigners to permanently reside in Vietnam, specifically:

Cases considered for permanent residence:

  1. Foreigners with meritorious services and contributions to the cause of construction and defense of the Vietnamese Fatherland are awarded medals or honorary titles by the Vietnamese Goverment.
  2. Foreigners are scientists and experts who are temporarily residing in Vietnam.
  3. Foreigners who are guaranteed by their father, mother, wife, husband and children who are Vietnamese citizens who are permanently residing in Vietnam.
  4. Stateless people who have temporarily resided continuously in Vietnam from 2000 or earlier”.

Conditions for permanent residence: 

Foreigners are considered for permanent residence when meeting the following conditions:

  1. Having a legal place of residence and a stable income to ensure a life in Vietnam; 
  2. Foreigners who are scientists or experts temporarily residing in Vietnam must be requested by the Minister, Head of ministerial-level agency or government-attached agency in charge of state management of his/her professional field;
  3. Foreigners who are guaranteed by their father, mother, spouse and children who are Vietnamese citizens who are permanently residing in Vietnam and have temporarily resided in Vietnam for 03 consecutive years or more. 

Regarding procedures for permanent residence:

The new law specifies and details the procedures for granting a permanent residence card:

Profile include:

“a) Application for permanent residence;

  1. b) Judicial record issued by the competent authority of the country of which the person is a citizen;
  2. c) A note of the representative mission of the country of which the person is a citizen, requesting that Vietnam settle for such person’s permanent residence;
  3. d) Certified copy of passport;
  4. dd) Papers proving eligibility to be considered for permanent residence;
  5. e) Letter of guarantee for foreigners who are guaranteed by their parents, spouse, children who are Vietnamese citizens and are permanently residing in Vietnam.  

Legal basis of administrative procedures:

+ Law on foreigners’ entry into, exit from, transit through, and residence in Vietnam (Law No. 47/2014/QH13, dated June 16, 2014).

+ Circular No. 219/2016/TT-BTC dated 10/11/2016 of the Ministry of Finance regulating collection, payment, management and use of fees and charges in the fields of exit, entry, transit and residing in Vietnam.

+ Circular No. 04/2015/TT-BCA, dated January 5, 2015 of the Ministry of Public Security, providing forms related to entry, exit and residence of foreigners in Vietnam.

+ Circular No. 31/2015/TT-BCA, dated July 6, 2015 of the Ministry of Public Security guiding a number of contents on issuance of visa, temporary residence card, immigration permit, permanent residence settlement for foreigners in Vietnam.

Procedures:

“Within 04 months from the date of receipt of a complete dossier, the Minister of Public Security shall consider and decide to grant permanent residence; In case it is deemed necessary to carry out additional verification, the extension may be extended but not exceeding 02 months.

The immigration management agency is responsible for notifying in writing the settlement result to the applicant for permanent residence and the police station of the province or city directly under the central government where the foreigner applies for permanent residence.

Within 05 working days from the date of receipt of the notice from the immigration management agency, the police station of the province or city directly under the central government where the foreigner applies for permanent residence shall notify the foreigner to be accepted for permanent residence. reside.

Within 3 months after receiving the notice of settlement for permanent residence, the foreigner must go to the immigration management agency of the police station of the province or centrally run city where he/she applies for permanent residence to receive a permanent residence card. .
